GAR nominates CIS Economic Court judgment among 10 most important judgments of 2014 Global Arbitration Review (‘GAR’) has nominated the judgment of the CIS Economic Court on the interpretation of the 1997 Moscow Convention for Protection of Investors’ Rights, as one of 10 most important judgments of 2014. Satatov, Askarov & Partners acted for the Kyrgyz Republic in the proceedings. GAR comments that the judgment ‘prevented a potential flood of claims at so-called "pocket” arbitration courts’. The other 9 nominations include, for example, the US $50 billion award against Russia in favour of Yukos shareholder, so far the largest arbitral award in history. Read more

KYRGYZSTAN’S FIRST VICTORY IN INTERNATIONAL INVESTMENT ARBITRATION In international arbitration in Toronto, Canada, Satarov, Askarov & Partners jointly with US firm Winston & Strawn acted for the Kyrgyz Government and have achieved withdrawal of all of US $17 mln claims by US investor Ilia Levitis relating to nationalisation of AsiaUniversal Bank. KYRGYZSTAN CONTINUES TO PREVAIL IN INTERNATIONAL ARBITRATIONS CONCERNING NATIONALISATION OF ASIAUNIVERSALBANK In international arbitration proceedings in Dublin, Ireland, Satarov, Askarov & Partners, jointly with US firm Winston & Strawn, have secured a $280,000 costs award against a US company Ithaca Holdings Inc and former chairman of AsiaUniversalBank Mikhail Nadel after withdrawal of their US $400 mln claims regarding nationalisation of AsiaUniversalBank. Nadel has re-filed his separate claim in a new proceeding but Ithaca has abandoned its US $68 million claim and is now time-barred to re-file it in a separate proceeding. Read more
ASIAUNIVERSAL BANK CHAIRMAN FILES EVIDENCE IN BANK NATIONALISATION CLAIM After a two year delay, оn 15 September 2014, former AsiaUniversalBank Chairman Mikhail finally filed evidence in London-seated arbitration proceedings relating to his bank nationalisation claim against the Kyrgyz Government. In the recent filing, Nadel reduced his claim from US $450 million to US $65 million. Hearing expected in late 2015. Kyrgyzstan will defend the claim. CIS ECONOMIC COURT UPHOLDS KYRGYZSTAN’S INTERPRETATION OF REGIONAL INVESTMENT TREATY On 23 September 2014, CIS Economic Court upheld Kyrgyzstan’s interpretation of of the Convention for Protection of Investors’ Rights 1997 (in effect for Armenia, Belarus, Kazakhstan, Kyrgyzstan, Moldova and Tadjikistan) that has been used to bring a series of US $143 mln investor-state claims against Kyrgyzstan. The judgment limits investors’ rights to arbitrate US disputes to institutions specified in bilateral treaties, national laws or specific agreements. Satarov, Askarov & Partners acted for Kyrgyz Government in the case.

About us

Satarov, Askarov & Partners is a law firm based in Bishkek, capital of Kyrgyzstan.

The firm emerged from a 15-year joint practice of its founding partners, Ulan Satarov and Anvar Askarov. It came to prominence in the domestic and international legal markets in 2012 when it acted for the Kyrgyz Government in three international arbitration proceedings in which foreign investors claimed over US $450 million against the Government for nationalisation of once Kyrgyzstan’s largest commercial bank, AsiaUniversalBank. Not only did we achieve withdrawal of claims against the Government but it also obtained US $700,000 costs awards against the claimants. Whilst international arbitration and foreign investment remain the core of "Satarov, Askarov & Partners' practice", the firm offers an wide range of commercial legal services including in the areas of corporate M&A; debt finance; natural resources; anti-monopoly and competition; taxation and tax litigation, international trade, customs and customs litigation; criminal law in the business context.
